1. Purpose
These Terms and Conditions define the conditions under which Artworks Digital provides a SaaS service for the creation and hosting of multi-tenant e-commerce stores for artists and merchants.
2. Roles and Responsibilities
Platform (Artworks Digital): provides the infrastructure, availability, security, SaaS billing and tools (catalog, payment, orders, analytics with consent).
Merchant: responsible for content, pricing, inventory, deliveries, customer service and store compliance (specific T&Cs, legal notices, VAT, customs, right of withdrawal, after-sales service).
3. Store Creation and Management
Each store has an isolated space (multi-tenant). Data is not shared. The merchant manages their pages, products, prices, promotions and specific consumer terms.
4. Orders and Payments
Payments are processed through third-party providers (e.g., Stripe). The merchant is responsible for the proper execution of orders, issuing invoices and compliance with legal obligations (VAT, customs, withdrawal rights).
5. SaaS Pricing and Billing
SaaS fees (subscription, potential commissions) are billed to the merchant according to the conditions specified at the time of subscription. Product prices on each store are freely set by the merchant.
6. Intellectual Property
The merchant retains ownership of their content (texts, images, artworks). The platform retains ownership of the code, features and Artworks Digital brand elements.
7. Personal Data & GDPR
The platform acts as a data processor for merchant customers' data. Each merchant is responsible for informing their customers and collecting the necessary consents (e.g., marketing/analytics cookies). The platform provides a consent banner that activates trackers only after acceptance.
8. Cookies & Analytics
Non-essential cookies (analytics/marketing) are loaded only after explicit user consent via the banner. The merchant must publish their own cookie policy/T&Cs adapted to their store.
9. Security and Availability
The platform implements security measures (TLS, tenant isolation, backups). A best-efforts obligation is provided for service availability.
10. Support
Technical support for merchants via contact@artworksdigital.fr. End customer support (buyers) is provided by each merchant.
11. Termination
Termination is possible according to the terms of the SaaS contract. Data can be exported upon reasonable request, subject to legal retention obligations.
12. Applicable Law
French law applies. Any dispute shall be submitted to the competent courts after an attempt at amicable resolution.
